Terms of Service

These Terms of Service ("Terms") govern your use of BaySync ("we", "us", "our"), a service department operations platform used by automotive dealerships to manage repair orders, appointments, vehicle inspections, and customer communications. By interacting with BaySync — including by receiving text messages we send on a dealership's behalf, by using a BaySync-powered booking form, or by viewing an inspection report or estimate we deliver to you — you agree to these Terms.

BaySync acts as a service provider to the dealership that serves you. The dealership is responsible for the underlying service relationship, pricing, and the work performed on your vehicle. BaySync provides the software platform that supports those operations.

SMS Program Terms

The BaySync messaging program ("Program") delivers service-related text messages to customers of partnering automotive dealerships. By providing your mobile phone number to a participating dealership, or by opting in through a BaySync-powered form, you consent to receive recurring text messages from BaySync on the dealership's behalf in accordance with these Terms.

Program description

The Program sends transactional and service-related notifications including: appointment confirmations, arrival check-ins, no-show check-ins, waitlist offers, vehicle status updates, parts-arrival notifications, return-visit booking links, multi-point inspection report delivery, repair estimates, and follow-up offers for service work previously declined or recommended.

Message frequency

Message frequency varies based on your service activity. You should expect to receive messages tied to each active appointment or repair order — typically between two and ten messages per visit — plus occasional follow-up messages.

Cost

Standard message and data rates from your wireless carrier may apply. BaySync and the partnering dealership do not charge a fee to receive Program messages. Check with your wireless carrier for details of your messaging plan.

How to opt out

You may opt out of the Program at any time. Reply STOP to any message from a BaySync number to unsubscribe. After you send STOP, we will send you a confirmation message and you will not receive further messages from that number unless you re-enroll. You may re-enroll at any time by replying START,UNSTOP, orYES, or by providing your phone number again to the dealership during a future service visit.

Supported carriers

The Program is available on most major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, Boost, MetroPCS, Cricket, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages.

No sharing for marketing

We do not share your phone number, opt-in status, or message content with third parties for marketing or promotional purposes. Information about how we use your data is described in our Privacy Policy.

Accuracy of your phone number

You agree to provide accurate contact information to the dealership and to notify the dealership if your phone number changes. If your number is reassigned to another person and you do not notify the dealership, that person may receive messages intended for you until they opt out.

Use of customer-facing pages

BaySync may send you links to view your inspection report, repair estimate, parts-return booking page, or appointment confirmation. These pages are accessible without a password via a unique link tied to your repair order or appointment. Treat these links as confidential and do not forward them to people you do not want to view your service information.

Approvals you submit through these pages — such as approving or declining recommended repair work, or signing an estimate — are recorded with a timestamp and become part of the dealership's service record. The dealership may rely on these approvals to perform the authorized work and order parts.

Service relationship with the dealership

BaySync is not a party to the service contract between you and the dealership. Questions about pricing, repair work performed, warranty, scheduling, vehicle pickup, payment, or the conduct of dealership staff should be directed to the dealership. BaySync provides the software platform that supports the dealership's operations and the communications we send on their behalf.

Disclaimers

The BaySync platform and customer-facing pages are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, BaySync disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that messages will always be delivered on time, that links will always be accessible, or that the service will be uninterrupted or error-free.

Some information shown in BaySync (such as appointment, repair order, and service history records) is sourced from the dealership's dealer management system and other third-party systems. That information may lag, be incomplete, or contain errors originating in those systems; the dealership's own records remain the system of record for your service work.

Limitation of liability

To the fullest extent permitted by applicable law, BaySync will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the platform or receipt of messages. Our total liability for any claim arising from these Terms is limited to the greater of one hundred U.S. dollars ($100) or the amount you have paid directly to BaySync in the twelve months preceding the claim (which, for customers of a dealership, is typically zero).

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of BaySync will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the platform or continued participation in the SMS Program after a change constitutes acceptance of the updated Terms. Material changes will be communicated through the BaySync service or by the dealership that serves you.
